“STEPS TO CREATING YOUR NON-PROFIT” CHECKLIST

Here’s a useful checklist to get up and running fast. Of course, reflects the steps in our No-Lawyer Non-Profit Launch Kit, which is scheduled for release in mid-June. Sample Non-Profit Bylaws

It’s a worn-out cliche, but one thing I always tell our clients is “Keep it Simple.” Your bylaws should cover the bases but should set your organization up for maximum freedom to operate without unneeded formality. You can always amend later after you get non-profit status, when you expand your staff and program scope.

Sample Narrative of Activities (1 of 2)

Your Narrative of Activities is where the rubber meets the road. This document, which must be attached to your Form 1023, is where you tie your organization’s on-the-ground activities to your mission and purpose. It’s required to get non-profit status and your tax-exempt determination letter from the IRS.

 

Sample Narrative of Activities (2 of 2) Your Narrative of Activities should provide “concise detail,” and avoid indicating any activities that are prohibited for tax-exempt organizations. Your Narrative ties your day-to-day activities to your charitable, tax-exempt purpose. Even an honest mistake regarding your activities could have you languishing for years in IRS delays. After you get non-profit status at the state level and move on to your Form 1023, a solid Narrative will help obtain your “determination letter” as a tax-exempt organization.

Non-Profit Conflict of Interest Policy

While the IRS might not list a Conflict of Interest (COI) Policy as a requirement, it frowns upon organizations that do not make it very clear that conflicts are avoided. Besides, it is now specifically inquired about on both the Form 1023 Application for Tax-Exempt Status and the annual 990 Tax Return.
